UNANIMOUS DEFENSE VERDICT ON BEHALF OF INTERNAL MEDICINE PHYSICIAN IN KINGS COUNTY
The Law Office of Benvenuto & Gaujean, represented by Max Gaujean and Sabrina Valdez, successfully secured a unanimous defense verdict on behalf of an internal medicine physician in Kings County in January 2025. The plaintiff initially presented to our client with complaints of chest pain radiating to the left shoulder. Our client assessed the condition as stabilized, referred the plaintiff to a cardiologist. The cardiologist advised her to proceed to the emergency room if she had recurring chest pain that persisted for more than 15 minutes. After consulting two other physicians, the plaintiff returned to our client, who again recommended that she seek immediate care at the hospital emergency room. Despite these directives, the plaintiff did not proceed to the hospital. Two days later, the plaintiff contacted our client, reporting persistent discomfort and was once again instructed to seek emergency medical attention, which she again declined. The plaintiff later alleged that our client advised her to remain home and attributed her symptoms to anxiety. The plaintiff subsequently suffered a cardiac arrest, requiring defibrillation three times before resuscitation, followed by a stroke. Despite these events, the plaintiff made an excellent recovery with minimal residual effects. At summation, the plaintiff sought damages amounting to $3,524,000. After deliberation, the jury returned a unanimous verdict in favor of our internal medicine physician.
