PLASTIC SURGERY UNANIMOUS VERDICT

Attorneys, James Jankowski and John Iacone, obtained a defense verdict on behalf of a plastic surgeon in December 2022. The plaintiff was a 45 year old female who presented to the plastic surgeon for breast augmentation following a rupture of a prior breast implant.

The plaintiff alleged that the breast augmentation performed by our plastic surgeon was not properly performed, resulting in a cosmetic deformity. Additionally, the plaintiff alleged that informed consent was not properly obtained as the plaintiff claimed that the implants utilized during the procedure were too large. The plaintiff subsequently elected to undergo a revision breast augmentation using smaller size implants.

At the time of trial, the plaintiff argued that she wanted the plastic surgeon to utilize the same size implants as her prior breast augmentation, and that the implants inserted by our plastic surgeon were larger than what she had wanted, resulting in cosmetic deformity. The defense argued that the implants utilized by the plastic surgeon during the breast augmentation were consistent with what the plaintiff had requested preoperatively. After the defense rested, the claim for medical malpractice was dismissed. At the conclusion of the trial, the jury rendered a verdict in favor of the defendant on the claim for lack of informed consent.
