UNANIMOUS VERDICT FOR CERTIFIED NURSE-MIDWIFE

The Law Offices of Benvenuto & Gaujean, by Lloyd Cohen and Max Gaujean, obtained a defense verdict on behalf of a Certified Nurse-Midwife in Bronx County in November 2023. In summary, the plaintiff presented to a OB/GYN clinic located in the Bronx to rule out an ectopic pregnancy.  The instructions provided by the Certified Nurse-Midwife to the plaintiff was to have her Beta-HCG checked to rule in or rule out an ectopic pregnancy.

It was the contention of the plaintiff that the Certified Nurse-Midwife failed to provide urgent and proper instructions to obtain a blood test to assist in ruling out an ectopic pregnancy.   As a result, it was alleged the plaintiff was deprived the opportunity to treat the ectopic pregnancy medically through medication and having to undergo a more extensive surgery.

It was the defense’s position that the plaintiff received appropriate, proper and urgent instructions to obtain the laboratory test to assist in ruling out an ectopic pregnancy and the plaintiff’s injuries were due to the plaintiff’s failure to timely obtain the test.  The jury rendered a unanimous verdict in favor of our client.
