DISMISSAL OF CARDIOLOGIST/PRIMARY CARE PHYSICIAN

In January of 2024, attorney Ginette M. Portera secured summary judgment in a Bronx County case in favor of the patient’s cardiologist/primary care physician.  The case involved a 69-year old male who was referred to a cardiothoracic surgeon for planned cardiac surgery in July of 2015.  Following the procedure, the patient spent an extended period of time in the CT ICU and developed a sacral injury that was acknowledged in the hospital to be a Stage II pressure injury and a Deep Tissue Injury (DTI). Following discharge, the sacral wound became infected and was debrided multiple times.  The patient last saw the cardiologist/primary care physician in February of 2016, and his records indicated that the sacral wound was healed.  Plaintiff claimed that the wound was not fully healed until mid-2017.
