DIRECTED VERDICT IN FAVOR OF EMERGENCY ROOM PHYSICIAN

Paul Nasta, Esq. represented a Board Certified Emergency Room physician in a wrongful death lawsuit which went to trial in Supreme Court, Suffolk County in December, 2024.  The case involved a 76 year old female patient who died less than three hours after entering the emergency room.  The patient complained of abdominal pain, nausea and vomiting.  She was medicated for pain and, shortly after receiving the third dose of narcotic pain medication, the patient suffered a cardiac arrest and died.  It was claimed that our client improperly administered an excessive dose of narcotic pain medication to the patient, causing the arrest and the patient’s death.  At the close of the plaintiff’s case, our motion for a directed verdict was granted by the Court, thereby dismissing the case.
