UNANIMOUS VERDICT FOR PEDIATRICIAN

The Law Offices of B&G by Dino Litourgis obtains a defense verdict. In March of 2024, plaintiff alleged that the physician and his staff were negligent in connection with a blood draw performed in a private office setting. The then 10-year-old plaintiff experienced a syncopal episode shortly after a blood draw was performed as part of her work-up. As a result, the plaintiff fell and suffered a laceration to her chin resulting in a permanent scar. Plaintiff claimed that the physician and his medical assistant could have prevented the fall, and that their failure to take certain precautions constituted medical malpractice.

At trial, Mr. Litourgis refuted those claims, demonstrating that the plaintiff’s medical history and clinical presentation did not warrant preventative measures that went above and beyond accepted protocol.

A Nassau jury rejected all plaintiff’s claims and reached a unanimous verdict in favor of our client.
