SUMMARY JUDGMENT FOR ATTENDING PHYSICIAN

In September of 2024, attorney Ginette M. Portera secured dismissal on summary judgment in a Bronx County case in favor of the patient’s attending physician at a nursing home facility. The physician faced allegations of a failure to prevent and treat a sacral pressure injury, failure to diagnose and treat pneumonia and respiratory failure, failure to order appropriate consults, failure to adequate control hypertension, failure to properly treat infection, and failure to transfer to a hospital.  As a result, the decedent, a 74-year-old female suffered from cardiac arrest, pneumonia, diarrhea, sacral pressure ulcer, fever, functional dyspepsia, constipation, hyperlipidemia, hypokalemia, anxiety, pyuria, hematuria, hypertension and death.
