DISMISSAL AGAINST BOARD CERTIFIED NEUROLOGIST AND EMPLOYED PHYSICIAN’S ASSISTANT

The patient, a then 64 year old female, claimed that our clients, a Board Certified Neurologist and an employed Physician’s Assistant, failed to diagnose and treat herpes encephalitis (a viral infection of the brain) during two office visits.  The patient had been seeing our clients for approximately 8 years, with a history of headaches, neck and back pain.  During the two office visits in question, the patient initially complained of lower back pain and headaches, but then presented to the office with reported delirium and urinary incontinence.  The patient claimed that as a result of a delay in diagnosis and treatment, the herpes encephalitis progressed and caused the need for admission to the hospital, lengthy treatment with anti-viral medications, and permanent cognitive, emotional and behavioral impairment.  A summary judgment motion filed by our attorney Paul Nasta was granted by the court, and the case against our clients was dismissed.
